SwapChat ("SwapChat", "we", "us", or "our") operates the website and application available at swapchat.live (the "Service"). The Service lets users video-chat with strangers and trade virtual collectible items using in-app virtual currency.
You must be at least 13 years old to use SwapChat. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Your feedback is welcome and helps us improve. By using the beta you acknowledge you may encounter bugs, interruptions, or data loss.
SwapChat does not currently require account registration. A unique device identifier is generated and stored locally in your browser to save your inventory and currency balance. You are responsible for keeping this data safe — clearing your browser storage will permanently delete your progress.
You agree not to use SwapChat to impersonate any person or entity, or to misrepresent your identity or affiliation with any person or organization.
You agree that when using SwapChat — including during video sessions, chat, and trading — you will not:
We reserve the right to terminate your access to the Service at any time for violations of this section, without notice.
SwapChat requests access to your device's camera and microphone solely to enable live video trading sessions with other users. Video streams are transmitted peer-to-peer via WebRTC and are not recorded or stored by SwapChat. We do not have access to your video or audio feed.
You are solely responsible for what you choose to display on camera. You consent to other users viewing your video stream during a session.
SwapChat features two types of virtual currency:

We make no guarantee that virtual items or currency balances will be preserved across updates, server resets, or the end of the beta period.
SwapChat includes a "pranks" feature that allows users to send humorous in-app animations to their session partner (e.g. "Pie to the Face"). These are visual effects only and are agreed upon implicitly by participating in the Service. If a session partner sends you a prank, no personal data is collected or shared as part of that interaction.
The pranks feature is intended to be lighthearted. Using it in a targeted or repeated way to harass a user may be considered a conduct violation under Section 5.
All content, design, code, graphics, and branding on SwapChat — including the name, logo, and virtual item artwork — are owned by or licensed to SwapChat and protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.
You retain ownership of any content you transmit through the Service (such as your camera feed or chat messages). By using the Service you grant us a limited, non-exclusive, royalty-free license to process and relay that content solely for the purpose of operating the Service (i.e. routing your video to your session partner).
Our use of your information is described in our Privacy Policy. By using the Service you agree to the collection and use of information in accordance with that policy.
In summary: we store a minimal anonymous profile (username, inventory, currency balance) tied to a device-generated ID. We do not collect your name, email address, or any personally identifying information unless you voluntarily provide it. Video streams are not stored.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SWAPCHAT AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF VIRTUAL ITEMS OR CURRENCY, OR LOSS OF GOODWILL — ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED $0, REFLECTING THAT NO MONETARY TRANSACTIONS OCCUR ON THE PLATFORM.
You agree to defend, indemnify, and hold harmless SwapChat and its operators from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third party's rights.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.
Sections 7 (Virtual Currency), 9 (Intellectual Property), 12–14 (Disclaimers, Liability, Indemnification), and 16 (Governing Law) survive termination.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SwapChat operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation in the first instance.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
For material changes, we will make reasonable efforts to notify users (e.g. via an in-app notice).
